Domain Registration

Domain Registration:

If some other party is able to get the domain name (that you have applied for) registered prior to you, then ABACOHosting cannot and shall not be held liable in such case. In case of any dispute arising out of this, the company's liability shall be restricted purely to making refund of the amount received by it for a new domain request and not beyond.

If in case the client has wrongly spelled his domain name then no refund will be applicable following the registration of domain.

You acknowledge that you have read ICANN Registrant Rights and have understood the responsibilities and rights that registrants (you) have with their domain registrar (ABACOHosting) when they have a domain name registered through them.

Domain Renewals:

You acknowledge that it's your responsibility to keep records and maintain reminders regarding the expiry of any service. As a convenience to the client, and not as a binding commitment, we may notify him of any expiring services or services due for renewal, via email message sent to the contact information associated with the customer in the ABACOHosting's database. Should renewal fees go unpaid for a service, the service will expire automatically & ABACOHosting will not be responsible for any loss that may occur due to expiry/termination of services.

Domain Transfer:

Due to the unpredictable nature of the transfer process, no guarantees are made regarding the amount of time a specific transfer may take. If the transfer of the domain is done by ABACOHosting.com on behalf of the account holder, a handling fee may be incurred. If the customer cancels service during the transfer period for any reason, all charges are considered earned.

All domain Registration/Renewals/Transfers are governed by ICANN Policy.

Thus, you agree to have read, understood, and acknowledge to be bound legally by the Registrar Transfer Dispute Resolution Policy; ICANN Rules for Uniform Domain Name Dispute Resolution Policy; this Agreement; any ABACOHosting policies and procedures that are or may be published from time to time by ABACOHosting, ICANN, and/or the Registry Administrator chosen by ICANN.

Nameservers and Servers:

It is the client's responsibility to change the nameservers. The propagation time for changes to reflect would be 48-72 hours and it can even exceed due to registry problems, ISP issues or technical factors whatsoever. 03

Hosting

Any action/processes that abuse/harm ABACOHosting's server or negatively impact other clients' service experience is strictly prohibited.

Processes

Processes invoked by the web server, cron, shell or any other method should not exceed the following limitations:

  • For any unacceptable or inappropriate material as determined by Parent in its sole discretion, including but not limited to Topsites, IRC Scripts/Bots, Proxy Scripts/Anonymizers, Pirated Software/Warez, Image Hosting Scripts (similar to Photobucket or Tinypic), AutoSurf/PTC/PTS/PPC sites, IP Scanners, Bruteforce Programs/Scripts/Applications, Mail Bombers/Spam Scripts, Banner-Ad services (commercial banner ad rotation), File Dump/Mirror Scripts (similar to rapidshare), Commercial Audio Streaming (more than one or two streams), Escrow/Bank Debentures, High-Yield Interest Programs (HYIP) or Related Sites, Investment Sites (FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme), Sale of any controlled substance without prior proof of appropriate permit(s), Prime Banks Programs, Lottery Sites, MUDs/RPGs/PPBGs, Hateful/Racist/Harassment oriented sites, Hacker focused sites/archives/programs, Sites promoting illegal activities, Forums and/or websites that distribute or link to warez/pirated/illegal content, Bank Debentures/Bank Debenture Trading Programs, Fraudulent Sites (Including, but not limited to sites listed at aa419.org & escrow-fraud.com), Mailer Pro.
  • Use over 25% of system resources, including but not limited to Memory, CPU, Disk, Network, and Bandwidth capacity, for longer than 90 seconds in any consecutive 6 hour period. These very heavy traffic websites will be intimated and asked to move to a more suitable platform by upgrading their package. You can optimize on this opportunity by pitching a better fitting option (for example, a VPS or a Dedicated Server) to these website owners so that they don’t have to suffer from consequences such as reduced website speed, etc. In case owners of these websites refuse to move or upgrade their package, we will start limiting the resources they can consume, which in turn will ensure that the rest of the users continue receiving the best quality service available.
  • Execute long-running, stand-alone, unattended server-side processes, bots or daemons.
  • Run any type of web spiders or indexers.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run, host, or store any P2P client, tracker, software, server, files, content or application, including bittorrent.
  • Participate in any P2P or file-sharing networks.
  • Use the email service for sending or receiving unsolicited emails.
  • Use the email service for sending or receiving emails through automated scripts hosted on your website. For sending out promotional emails, email campaigns, etc., we recommend using the Mailing Lists feature rather than using your email account. Upon detection of such mails going through the regular mailing system, such mails will get classified as spam even though the recipient might have opted in for receiving such mails. This would lead to immediate cessation of mail sending capabilities for the user or the domain name. Frequent violation would lead to permanent suspension of the domain name.
  • Sending mails to invalid recipient email addresses. On receipt of too many bounce back messages due to invalid recipient email addresses, the user sending such mails would get blocked. Frequent violation would lead to permanent suspension of the domain name.
  • Sending mails from an email address that is not valid and which results in triple bounces would result in suspension of the user sending such mails. Frequent violation would lead to permanent suspension of the domain name.
  • Send emails with malicious content. Such emails could be emanating from user(s) whose machine(s) are infected with a virus or malware and such activity could be happening without the user(s) knowledge or user(s) could be unknowingly sending out emails whose receivers may deem them as unsolicited.
  • Run cron entries with intervals of less than 15 minutes.
  • Engage in any activities related to purchase, sale or mining of currencies such as Bitcoin.

Termination for non-payment

Invoices for the renewal of services will be issued with at least 7 days before expiration and sent by our system to the email address that appears in the client's profile. Services with non-payment will be suspended on the day of expiration. The system will send 3 notifications to the client's email address, notifying about the lack of payment for the suspended service:

  • 1st Notice: Sent 1 days after the expiration date
  • 2nd Notice: Sent 5 days after the expiration date
  • 3rd Notice: Sent 7 days after the expiration date

A service suspended and renewed before 7 days of expiration will be automatically re-established. If a service is not renewed after 7 days from the expiration date, the COMPANY reserves the right to completely eliminate the service and all services related to it including the hosted content.

06

Backup/Restore Policy

  • We undertake periodic backups of data on our shared hosting servers, but the final responsibility for all backups of the data on your hosting packages rests with you. We strongly recommend that you take periodic backups and store them at your end so that you have multiple options in case of necessity for a restore.
  • You may request us for a back up of the last 7 days (from the date of request) and in most cases we will be able to provision this from our disaster recovery backups. However, this is not a part of our core hosting services and is merely a last resort. We will try our best to help you out but backups provisioning and restoration is an extremely time and resource intensive process and hence we can only promise a best effort service in this regard.
  • From the list of backups available and their date of generation you must select the date of the back up very carefully as we will only be able to undertake this task once a week. Also, there may be a possibility of missing files due to the time elapsed between date of backup and request for restoration, in such a case we will not be able to re generate the back up.
  • Please note that restoration of backups provisioned by us will be chargeable at USD 20 per site and/or cPanel Account, $55 for a Reseller Hosting package upto 10 cPanel Accounts. If a back up is provided by you then we will restore it for free.
  • We strongly recommended that you make use of Code Guard for reliable and cheap offsite back ups. Read more here
  • On Wordpress Hosting, VPS, Dedicated servers, Managed Servers and stand alone email solutions, we do not maintain any back ups that can be restored on a per server or package basis. For managed servers, you can buy additional SAN storage or another server and request us for back up configuration and we will be able to set this up for you.
